Introduction

These terms are the agreement between you and cntd when you use getcntd.com and anything that comes with it (together, "cntd"). By making an account or using cntd, you agree to them. If you don't agree, please don't use cntd.

On cntd, the person who posts a gig and books someone is the organiser, and the person they book is the artist. One account can be both.

Who can use cntd

You must be at least 18 to use cntd. If you use cntd for a business or a group, you confirm that you're allowed to agree to these terms for it.

There is one kind of account. Anyone can post gigs, apply for gigs, or both. You can sign up with an email address and password, or with Google.

How a booking works

  1. An organiser posts a gig, with one or more roles and a fee for each. Anyone except the organiser can apply.
  2. The organiser can message applicants, then accepts the one they want. cntd then writes a contract from the details of the gig.
  3. Both sides sign. The artist has to set up a Stripe payout account first, so there is somewhere to send their money.
  4. Both sides pay a deposit (see Deposits and payment).
  5. After the gig, the organiser confirms on cntd that it happened. That starts the final payment and the payout. cntd doesn't mark gigs as done by itself, so the organiser agrees to confirm once the gig has happened.

The contract says who, what, when, where and how much. It includes the cancellation rules below and is governed by Singapore law. The organiser can add their own terms in writing, or attach their own document, which then forms part of the contract. Read the contract before you sign it.

The contract is between the organiser and the artist. cntd is not a party to it, doesn't employ either side, and doesn't guarantee how the gig goes. cntd holds the deposits and handles the payments as these terms describe.

Fees

Making a profile, posting gigs and applying for them is free. cntd takes a fee only when a gig is booked. The organiser pays 5% of the gig fee on top of it, and the artist pays 5% out of it. If the booking is made less than 48 hours before the gig starts, or the gig is marked urgent, the organiser pays 10% instead; the artist still pays 5%. A booking's fee is fixed when it is made.

The organiser's share is added to what they pay. The artist's share is taken from their payout. The contract and the payment screen show the exact amounts before anyone pays.

cntd may give out beta codes that waive the fee for a time. An organiser's code waives the whole fee on their bookings. An artist's code waives their share. Each code works until the end date it was given.

Deposits and payment

After both sides sign, each pays a deposit: 20% of the gig fee, never more than SGD 200. cntd holds both deposits until the gig is done.

Once the organiser confirms the gig, they pay the rest: the gig fee plus their share of cntd's fee, minus their deposit. If the organiser has saved a card, it is charged automatically, and by saving a card the organiser agrees to that. The artist is then paid the gig fee minus their share of cntd's fee, and their deposit is returned the way they paid it.

Payments are handled by Stripe. Artists are paid into a Stripe account set up through cntd. That account comes with Stripe's own agreement, the Stripe Connected Account Agreement, and by setting one up you agree to it. You also let cntd share the details Stripe needs to make the payments. Money reaches the artist's Stripe account once the organiser's payment goes through. When it lands in their bank depends on Stripe. All amounts are in Singapore dollars.

Late payment

If the organiser still hasn't paid the rest 24 hours after it's due, cntd may add a late fee of up to 1.5% of the unpaid amount for each of the first three days, then 0.5% a day after that, up to 15% in total. 75% of any late fee goes to the artist, and the rest to cntd. If the balance stays unpaid, the organiser can't post new gigs until it is paid.

Cancelling and no-shows

Cancelling before both sides have signed costs nothing, because no deposit has been taken yet.

After both sides have signed, whoever cancels loses their deposit. The other side gets their own deposit back in full, to the card it came from, and the lost deposit as credit on their cntd account to put towards a future booking. The credit is not paid out as cash. The cancellation shows on the canceller's profile.

If the artist doesn't turn up and the organiser reports a no-show before the artist has checked in, the organiser's deposit is returned in full and the artist's deposit becomes credit for the organiser on the same terms.

Points and suspensions

Each cancellation after signing, and each no-show, adds points to your record: 1 if it's more than 7 days before the gig, 2 within 7 days, 4 within 48 hours, and 8 for a no-show. An organiser who cancels a gig gets points once for the gig, however many artists it had. Points last 90 days.

  • With 4 or more, people looking at your profile see a warning.
  • With 8 or more, you hear about last-minute gigs 30 minutes after everyone else.
  • With 16 or more, you can't post gigs or apply for them for a week.
  • If, over 12 months, you let people down 5 or more times and that is more than half of your bookings, you can't post or apply until cntd has reviewed your account.

Your profile shows your cancellations and no-shows from the last 12 months.

Appeals

If you had a good reason, you can appeal within 90 days. If cntd agrees, your record is cleared, but the money stays where it went. If a no-show was reported that didn't happen, you can appeal within 7 days. If cntd agrees, your record is cleared and your deposit is returned. Both sides can tell cntd what happened before cntd staff decide. Credit from a lost deposit can't be spent for 7 days, or while an appeal about it is open, so it can be given back if the appeal succeeds.

When something goes wrong

If something goes wrong with a booking that these rules don't cover, email hello@getcntd.com. cntd will look at what both sides tell us and try to help. The contract is still between the organiser and the artist, and cntd isn't responsible for how the gig went.

Reviews

After a gig, the organiser and the artist can rate each other. Neither sees the other's rating until both have rated, or 14 days have passed. A profile shows an average once it has 3 reviews. Reviews must be honest and about the gig.

Your account

Keep your login details safe. You're responsible for what happens on your account. Give accurate details and keep them up to date. Accounts are personal and can't be handed to someone else.

To delete your account and its data, email privacy@getcntd.com from the email address you log in with.

Your content

You own what you upload: your profile, portfolio, posts and messages. By uploading it, you let cntd show it on cntd and use it to run cntd, without paying you for it. You confirm that you have the right to upload it and that it doesn't break anyone else's rights.

What's not allowed

  • Posting anything false or misleading.
  • Harassing, threatening or discriminating against anyone.
  • Arranging or paying for a booking you found on cntd outside cntd, to avoid the fee.
  • Copying or scraping cntd's content without permission.
  • Uploading anything harmful, or trying to break cntd.
  • Breaking the law.

Suspending accounts

cntd can suspend or close an account, or remove content, if we reasonably believe it breaks these terms or puts other people or cntd at risk. You can close your account at any time by emailing us. Anything already owed under a booking still has to be settled.

Liability

As far as the law allows, cntd and its people aren't liable for indirect or knock-on losses from using cntd, or from not being able to use it. cntd's total liability for any claim is limited to the larger of what you paid cntd in the 12 months before the claim, or SGD 100.

Law and changes

These terms are governed by the laws of Singapore, and any dispute about them goes to the courts of Singapore.

We may update these terms. When we do, we'll change the date at the top and tell registered users by email or in the app. Using cntd after that means you accept the new terms.
